Renovation before completion

A recent decision from High Cour of Justice (Cour de Cassation) dated the 1st July 2020 confirmed that the purchaser of a property, who undertook some renovation work before completing, does so at its own risk.

In this case, a couple started the renovation of a property be&ore owning it. In the meantime their mortgage was refused and the transaction was cancelled. The couple request the reimbursement of funds advanced for the work carried out.

According to the judge, the work could not be described as urgent and necessary, did not concern the safety of the property, and was undertaken before the purchasers were certain to obtain their mortgage.
