The decree 2020-1422 dated the 20th November 2020, introducing the signing of an authentic power of attorney outside the Notaire's office, came into force on the 22nd November 2020 for an unlimited period. I will remind you that an authentic power of attorney is required when you sign a specific deed, such as an off plan property, a gift of a property, take out a mortgage with a guarantee in the form of an hypotheque, a French lasting power of attorney (mandat de protection future).

From now on, a person living outside France notably, can sign an authentic power of attorney with his Notaire. No need to go and see a Public Notary, have the power of attorney translated and apostilled. You will save time and money.

The decree remains silent regarding the standard undersigned power of attorney but some notaires already use a system that enable them to verify the identity of the person signing.
